The terms governing access to and use of DevOps with Prasad courses, learning platforms, content, and related services.

These Terms & Conditions (“Terms”) govern your access to and use of the DevOps with Prasad learning management system, websites, mobile applications, courses, content, and related services (collectively, the “Services”). By creating an account, enrolling in a course, or using any part of the Services, you agree to these Terms and our Privacy Policy.

1. Eligibility & Accounts

1.1 You must be at least 16 years old to use the Services.

1.2 You are responsible for safeguarding your login credentials and all activity under your account. Do not share your account or allow simultaneous logins for different people.

1.3 You must provide accurate information and keep it updated.

1.4 We may refuse registration or suspend an account if information provided is false, misleading, or incomplete.

2. Enrolment & Access

2.1 Upon successful payment or valid enrolment, you receive a limited, non-exclusive, non-transferable license to access purchased courses for the duration indicated on the course page or order confirmation.

2.2 Access may include live classes, recordings, downloadable resources, labs, assignments, and community forums as described for each course. We may update, improve, re-record, or replace modules without notice to maintain quality.

2.3 We may monitor participation, including progress and quiz attempts, for academic integrity, platform security, and quality improvement.

2.4 Access is for individual use only and may not be shared, resold, or transferred.

3. Course Content & Intellectual Property

3.1 All course materials, videos, slides, questions, labs, text, graphics, logos, and software are intellectual property of DevOps with Prasad or its licensors and are protected by applicable law.

3.2 You may not copy, record, reproduce, redistribute, sell, publicly display, or create derivative works from the content except where explicitly permitted in writing.

3.3 Downloadable templates and cheat sheets may be used only for personal, non-commercial learning.

3.4 Unauthorized use may result in immediate termination of access and legal action.

4. User Submissions & Feedback

4.1 By posting in forums or submitting assignments, projects, testimonials, or feedback, you grant DevOps with Prasad a worldwide, royalty-free, perpetual license to host, use, reproduce, and display that content to operate and improve the Services and for marketing, excluding your confidential personal data.

4.2 You confirm that you have the rights to content you submit and that it does not infringe others’ rights.

4.3 We may remove any user submission that violates these Terms or applicable law.

5. Academic Integrity & Acceptable Use

5.1 You agree not to:

  • Circumvent access controls, share credentials, or download or record classes without permission.
  • Engage in cheating, plagiarism, or misuse of labs or credentials, including cloud credits.
  • Upload malware, scrape the platform, or disrupt the Services.
  • Harass instructors, staff, or learners, or engage in discriminatory or unlawful conduct.

5.2 We may suspend or terminate access for violations, with or without notice and without refund of fees paid.

6. Pricing, Payments & Taxes

6.1 Prices are shown at checkout or on the course page and may change before purchase. Applicable taxes, including GST, will be added as required by law.

6.2 Payments are processed through approved payment gateways, UPI, cards, or wallets. You authorize us or our processors to charge your selected payment method.

6.3 Refunds: Unless expressly stated on the course page or invoice, or required by law, fees are non-refundable, especially after course access has begun or materials have been downloaded or attended. A stated refund or cancellation window will override this clause.

6.4 Failed, delayed, or disputed payments may result in suspended access until resolved.

7. Certifications & Outcomes

7.1 Participation or merit certificates may be issued at our discretion based on criteria such as attendance, assessments, or project completion.

7.2 Training is educational. No job placement or salary outcome is guaranteed. Placement assistance, if offered, is guidance only and is not an employment offer or guarantee.

8. Live Sessions, Recordings & Communications

8.1 Live classes may be recorded for quality assurance and later access by enrolled learners. By attending, you consent to being recorded through audio, video, or chat.

8.2 You agree to receive transactional communications by email, SMS, or WhatsApp about enrolment, schedules, assessments, and updates. You may opt out of marketing messages at any time.

9. Third-Party Services & Tools

9.1 Courses may reference or require third-party products such as AWS, GitHub, Linux distributions, and CI/CD tools. You must comply with their terms and licensing.

9.2 We are not responsible for third-party sites, outages, pricing changes, credit consumption, or data practices.

10. Privacy

Your data is handled according to our Privacy Policy. By using the Services, you acknowledge that we will process your information as described there.

11. Service Availability & Changes

11.1 We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates, or outages may occur.

11.2 We may modify or discontinue features or courses, including migrating to new versions, to improve quality or compliance.

12. Suspension & Termination

12.1 We may suspend or terminate access for violations of these Terms, suspected fraud, non-payment, or legal or regulatory requirements.

12.2 You may request account deletion as described in the Privacy Policy. Termination does not relieve payment obligations already incurred.

13. Disclaimers

13.1 The Services are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including fitness for a particular purpose.

13.2 We do not warrant that certifications, skills, or tools covered will meet employer requirements, or that course completion will produce specific results.

14. Limitation of Liability

To the maximum extent permitted by law, DevOps with Prasad and its instructors or staff will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability for a claim related to the Services will not exceed the amount you paid for the course giving rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless DevOps with Prasad and its personnel from claims, damages, liabilities, and costs arising from your misuse of the Services, violation of these Terms, or infringement of any rights.

16. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including outages, acts of God, regulatory changes, strikes, epidemics, or cyber incidents.

17. Governing Law & Dispute Resolution

17.1 These Terms are governed by the laws of India, with courts at Bengaluru, Karnataka having exclusive jurisdiction, subject to Clause 17.2.

17.2 At our option, disputes may first be submitted to confidential arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed under that Act. The arbitration language will be English. Each party bears its own costs, and the arbitrator may allocate fees as appropriate.

We will acknowledge your complaint and aim to resolve it within a reasonable timeframe as required under applicable consumer protection law.

19. Changes to Terms

We may update these Terms periodically. Material changes will be notified through email or dashboard alerts. Continued use after changes constitutes acceptance of the updated Terms.

20. Miscellaneous

20.1 No waiver of any term is deemed a further or continuing waiver.

20.2 If any provision is held invalid, the remainder remains in effect.

20.3 These Terms, together with the Privacy Policy and any course-specific rules or order forms, constitute the entire agreement between you and DevOps with Prasad.

20.4 If you are an enterprise client or have a signed agreement with DevOps with Prasad, that agreement prevails in the event of conflict.
